The Bankruptcy Process

The Process Begins
The bankruptcy process begins with a worksheet in my office. You go through a checklist and gather paperwork for my office and the bankruptcy court. I then draft your petition and follow up with you about any missing information.
When all the papers are together and you have completed a credit counseling class online or over the phone, you sit down with me and sign the petition for filing.
Chapter 7 Bankruptcy
You'll have one hearing about a month and a half after your bankruptcy petition is filed. Typically, that will be the only time you'll go to court. Afterwards, you receive your discharge from your debt.
Chapter 13 Bankruptcy
A Chapter 13 court hearing is usually about a month and a half after the petition is filed. You'll also have a debtor orientation class to complete. After you file, you'll begin making payments every month. You must keep the court updated if you move or if you have changes in expenses, etc.
How long does the process take?
Some of it depends on how quickly you get your paperwork together. Once that's done, the petition can be filed quickly. In Chapter 7, everything is typically wrapped up about three to four months after filing. In Chapter 13, you make your first payment 30 days after filing and you receive your discharge between three to five years later.
My Unique Approach
You sit down and meet with me for the initial consultation and to sign the paperwork. You'll meet with me at least twice before you go to court. That's very different from what you'll experience with a large law firm where you're often handed off to paralegals who handle the meetings and paperwork — and you don't actually meet your attorney until your day in court.
